Brother and Sister Involved in Serious Crash

Early on Saturday morning, March 21, a brother and sister were involved in a serious crash on Interstate 80.

According to Utah Highway Patrol, the accident happened shortly after midnight at the 105 mile marker near the Great Saltair. The driver of the vehicle, a blue Honda, was a 19 year old woman and her passenger was her 21 year old brother. They were traveling westbound on I 80 when the driver took her eyes of the road and the car went onto the left shoulder. When she realized she turned the wheel to the right then over corrected back to the left and the car hit the road barrier in the median.

The emergency services arrived and medical services were called as a precaution. Neither of the occupants were taken to hospital and both escaped without serious injury.

It is unknown if the driver was cited.

Girls Seriously Injured on ATV

On Friday on SR-73 in Eagle Mountain there was an accident resulting in two 15-year-old girls being in serious condition after their ATV was struck by an oncoming car.

The accident happened around 10:20 a.m. at milepost 17 near the entrance to 5 Mile Pass, which is a very popular ATV and motorcycle riding area just off the road filled with all kinds of hills and the trails are located on both sides of the road. The girls had attempted to cross SR-73 as they were been riding with friends. An oncoming PT Cruiser tried to stop, but then hit them broadside. SR-73 has a speed limit of 65 miles per hour road and Utah Highway Patrol troopers say the driver was able to slow down to about 30 miles per hour before impact. Nevertheless the impact sent the driver of the ATV over the top of the car and the passenger onto the shoulder of the road.

Neither girl was wearing a helmet. Officials say the girls didn’t look both ways and were following some friends who had already made it across the street safely. Both girls were taken to Salt Lake City area hospitals, one girl airlifted via helicopter while the other was transported in an ambulance.

Walmart Full Due to Crash

On Wednesday there was major accident on the westbound Interstate 80 when a semi laden with batteries and drums of acid hit a parked semi in Echo Canyon. The critically injured driver of the moving vehicle was airlifted to a Salt Lake City hospital.

The accident happened in the very early hours of the morning and was followed by a major blaze. Firefighters had to confirm the type of hazardous materials before starting to attack the fire. Following this the road surface, which was badly damaged, had to be taken up and replaced.

As a result of all of this activity, the road was not completely reopened until nearly 6 p.m. at night.

Meanwhile drivers were stranded in Evanston throughout the day, many looking for places to park and others trying to find an alternative route.

The parking lot in Walmart was packed with semis, campers and other vehicles, and nearby restaurants were all full as well. Long-haul, truck driver, Gregory Leigh, said that he had been driving 12 years and was used to getting stuck due to I-80 closures but that it was usually due to winter snow and didn’t often happen in the summer.

Bad driving decisions take lives

Utah has suffered one of its worst Fourth of July weekends in the past twenty years with at least 11 confirmed traffic deaths over the holiday weekend.

There were two major accidents. The first happened on Interstate 80 when Paul Mumford of West Jordan for some reason drove on the wrong side of the road and hit an SUV being driven by Jose Adame-Orozco of Farmington.

The three passengers in the SUV were killed at the scene and they were Delphine John, 44 and her two daughters aged 19 and 3. Mumford has now been charged with murder, manslaughter and driving under the influence.

The second accident, which happened on Route 191, involved a sports car and a minivan with one of the vehicles trying to pass without there being sufficient space. The result was a head on collision and the sports car burst into flames killing both occupants. Four people in the minivan were killed.

No Cap on GM Victim Compensation

GM Compensation

With the news that GM have appointed Kenneth Feinberg as the administrator for their compensation fund, families who have been fighting their claims for years should shortly received their payouts. This is the final stage to compensate those families and injured parties who suffered accidents due to a faulty power switch installed in some GM models.

Feinberg has said that he has total authority under the protocol awarded to him by GM and that the auto manufacturer will have no say as to who is eligible, nor the amount to be paid. He also confirmed that there will be no cap on the amount paid to any one family or individual

There will be a mathematical calculation to ascertain how much each family or victim should receive based on lost earnings over the lifetime of the victim and an additional amount for pain and suffering. He invited the family members and victims to contact him so that they could go and see him, or he would go to them, to discuss their individual cases.

General Motors Report Leads to Firing of 15 Officials

The much awaited General Motors report detailing the company’s failings with relation to its automobile recall program has been released. Among the findings of the report were that the company’s CEO, Mary Barra, and her top lieutenants, were not culpable for the breakdowns which led to the recall fiasco, and that company had failed on several levels to act responsibly.

Tellingly, the company’s chief executive officer said that her engineers believed the problems, which led to cars losing power while under operation and losing power to their airbag systems, was thought by her engineers to be an issue of owner satisfaction as opposed to a technical manufacturing issue. Still, Barra claims that she does not know how such a critical mistake could be made by senior engineers.

As a result of the report General Motors fired 15 employees, several which held senior positions. But, with Barra claiming that she does not know how such a fatal miscalculation could be made by the company in the first place, one wonders what kinds of policies she will to put in place be in order to ensure that such a tragedy does not happen again.

Barra did also promise that the company would compensate “everyone who has lost a loved one or suffered a serious injury”. However she failed to provide details about how such compensation would be determined or disbursed.

10 Year-Old Girl Dies From Injuries After Being Struck by School Bus

A Utah girl has died after being involved in a serious accident in late April.

According to the South Jordan Police Department a 10 year-old girl was getting off of her school bus when she inexplicably crossed in front of oncoming traffic and was struck by a second school bus. According to witness statements, the driver of the school bus which struck the girl did not see her before colliding with her.

The victim, a student at Welby Elementary School, was rushed to Intermountain Medical Center, and from there flown to Primary Children’s Hospital in critical condition. Police say that the girl suffered severe head trauma in the accident. She died from her injuries two days after the accident.

Police have not announced any criminal charges as a result of the accident, and according to standard procedure, the driver of the bus which struck the girl has been placed on paid leave. Police say they do not believe the diver of the bus which struck the girl was distracted at the time of the incident.

In the wake of the tragedy, the Jordan School District is reviewing its school bus safety policies.

Utah Woman Dies in I-15 Accident

Over the weekend a woman was killed in an auto accident in northern Utah near Brigham City.

Saturday evening a car carrying three passengers, including two women, ages 57 and 24, and a 25 year-old man, suffered an accident near mile marker 362 on northbound Interstate 15.  The car rolled over, ejecting the 57 year-old woman, who was the driver.  Authorities believe that she may have suffered from a medical condition which caused her to lose consciousness as she drove.

The woman suffered serious injuries including injuries to her leg and internal organs.  Though she was reportedly stabilized before being flown in a helicopter to a local hospital, later reports indicate that she succumbed to her injuries and passed away the same day.  It is not immediately clear whether or not the driver was wearing a seat belt prior to the crash.

Toyota Defect Costs Company $1.2 Billion – General Motors Likely Next

In our last post we talked about defective vehicles, and mentioned the Toyota situation as an example. Since that blog, a lot has happened. Not only has the Toyota defective vehicle situation reached a startling and historic conclusion, but now General Motors is on the hot seat with the government and consumers. But first, some background:

In 2009 and 2010 Toyota cars were reported to be suffering from a defect which caused them to spontaneously accelerate, without the driver’s pressing the gas pedal. The scandal, which actually caused the president of the Japanese auto-maker to personally apologize, was not only a result of the problem itself, but also due to the fact that the company waited to recall the affected vehicles, putting additional drivers in danger. Because of the defect, Toyota faced numerous lawsuits, including a criminal probe by the U.S. government. The company recently settled with the government for $1.2 billion.

This striking settlement comes just as another major auto-maker, General Motors, is undergoing its own scandal. In its case, GM also failed to recall cars which seem to have been defective, leading to over a dozen deaths. After the hefty sum paid out by Toyota due to its defective vehicles, it seems that General Motors is also going to have to pay out millions, if not billions, of dollars as a result of lawsuits over its defective vehicles.

Major auto manufacturers must be held accountable for any defective cars or trucks they produce and sell. Defective Vehicles

Auto accidents often involve defective vehicles. You have probably seen a few highly-publicized recalls in the news in the last few years, such as the Toyota recalls for faulty air bags and defects causing unintended acceleration. What you may not know is that defects causing accidents and injuries are not uncommon, and most do not make the news, and many never result in a recall.

Examples of Defects

The majority of motor vehicle defects fall in one of two categories. Either a defect which can cause accidents, or a crashworthiness defect which causes injuries when an accident occurs.

Examples of defects which cause accidents include:

  • Faulty tires
  • Suspension system defects
  • Power steering defects
  • Faulty brake systems
  • Defective design leading to rollover

Examples of crashworthiness defects include:

  • Defective seat belts
  • Defective air bags
  • Poor roof crush resistance
  • Fuel system defects

Of course, there are some defects which have the potential of causing an accident, causing injuries in the event of an accident, or both. For instance, a faulty airbag can cause an accident by deploying when it should not.
